TERMS AND CONDITIONS


  1. A separate, $350.00 (three hundred fifty USD) non-refundable booking fee must be paid to Lazy B Acres Sporthorses, when mare owner returns this contract.


  1. A copy of the mare's registration papers (if available) must be submitted with the contract if the mare is to be included in any report of mares bred.


  1. Documentation: A Semen Evaluation Certificate for Transported Semen will be sent with each shipment of semen.


  1. Pre-Shipment Steps: In addition to the signed contract and the booking fee, Lazy B Acres Sporthorses must receive the $650.00 (six hundred fifty USD) Stud Fee before live semen is shipped to mare owner. No part of the stud fee will be returned after at least one shipment is made.


  1. We recommend a current uterine culture before live semen is shipped, but do not require one at this time.


  1. For each collection of semen the mare owner will be charged a collection fee of $250.00 (two hundred fifty USD). All shipping costs are to be the sole responsibility of the mare owner and will be charged by New England Breeders in Winchendon Mass.


  1. Live Foal Guarantee: It is agreed that, under this contract, a live foal will be guaranteed from the transported semen for a maximum of two consecutive breeding seasons. A live foal is defined as a newborn foal that stands and nurses. If the foal is born dead, return privileges may be exercised by the mare owner for the followin season, if Lazy B Acres Sporthorses is notified within seventy-two (72) hours from the foaling date AND receives a veterinarian's statement concerning the circumstances of death within ten (10) days of the foaling date. If the mare dies, or after examination by one licensed veterinarian, is found unfit to breed, another mare may be substituted with the consent of Lazy B Acres Sporthorses. If the mare is examined by a licensed veterinarian and found to be barren fifty (50) to seventy (70) days from the last date of insemination, return privileges are also granted. If, after one breeding season, the mare does not conceive, the mare owner may substitute anther mare with the consent of Lazy B Acres Sporthorses. In any event, no more than two (2) consecutive breeding seasons will be honored. A separate booking fee will be due for the second season for the mare.


  1. Breeding season opens April 1, 2010 and runs through September 1, 2010.


  1. Semen remains the property of Lazy B Acres Sporthorses and must be accounted for. It is understood that the transported semen may be used ONLY for the mare designated on this contract and that all excess semen must be destroyed. Should the semen be used on a mare other than the mare so designated on this contract, without written permission from Lazy B Acres Sporthorses, this contract becomes null and void, is strictly forbidden and constitutes theft. A separate stud fee is immediately due for each embryo conceived and successfully implanted in a host mare.


  1. A licensed veterinarian must examine the mare 16 (sixteen) to 30 (thirty) days after the last insemination date and mare owner must advise Lazy B Acres Sporthorses, in writing, of the mare's pregnancy status, or the live foal guarantee if this contract shall become null and void.


  1. Lazy B Acres Sporthorses assume responsibility only to deliver live semen, in viable condition at the time of shipping, to the mare owner, or his or her designee. The semen must be administered by a licensed veterinarian on the day of delivery; otherwise all conditions of this contract become null and void.


This contract must be filled out in full. The mare owner must sign and return it to Lazy B Acres Sporthorses. When signed by Lazy B Acres Sporthorses and a copy is returned to the mare owner, it will then be a binding contract on both parties, subject to all the above terms and conditions.


THIS CONTRACT MAY NOT BE ASSIGNED OR TRANSFERRED BY THE MARE OWNER.
