TERMS AND CONDITIONS

1)Pre-Shipment Steps:  In addition to the signed contract, Lazy B Acres Sporthorses must receive the $1,000.00 (one thousand USD) Breeding Fee before frozen semen is shipped to mare owner.  No part of the Breeding fee will be returned.

2)Lazy B Acres Sporthorses agrees to provide to Mare Owner 3 breeding doses.  Only 1 Breeding Certificate will be issued for each breeding fee paid.

3)A copy of the mare's registration papers (if available) must be submitted with the contract if the mare is to be included in any report of mares bred.

4)  We recommend a current uterine culture before frozen semen is shipped, but do not require one at this time.

5)  Paid Breeding fee includes a one time only shipping container rental fee.    For each shipment of frozen semen the mare owner will supply New England Breeders Service a credit card for the shipping costs.  All shipping costs are to be the sole responsibility of the mare owner and will be charged by New England Breeders Service in Winchendon MA.  New England Breeders Service may be reached at 978-808-9966.  

6)   There is NO Live Foal Guarantee

7)  All Semen provided pursuant to this contract is sold in an “AS IS” condition.  Lazy B Acres Sporthorses makes no guarantee or warranty as to the fertilizing capacity of any semen provided under the terms of this contract, either express or implied, and all such warranties are specifically disclaimed.

8)  Semen remains the property of Lazy B Acres Sporthorses and must be accounted for.  It is understood that the transported frozen semen may be used ONLY for the mare designated on this contract.  Remaining semen may be purchased by executing a second contract for a second mare and paying a seperate breeding fee to Lazy B Acres Sporthorses. Should the semen be used on a mare other than the mare so designated on this contract, without written permission from Lazy B Acres Sporthorses, this contract becomes null and void, is strictly forbidden and constitutes theft.  A separate breeding fee in the amount of $1,000.00 (one thousand USD) is immediately due for each mare bred and/or each embryo conceived and successfully implanted in a host mare.

9)  Lazy B Acres Sporthorses assume responsibility only to deliver frozen semen,  to the mare owner, or his or her designee.  The semen must be administered by a licensed veterinarian.

10)  A licensed veterinarian must examine the mare within16 (sixteen) days after the last insemination date and mare owner must advise Lazy B Acres Sporthorses, in writing, of the mare's pregnancy status.
  
This contract must be filled out in full.  The mare owner must sign and return it to Lazy B Acres Sporthorses.  When signed by Lazy B Acres Sporthorses and a copy is returned to the mare owner, it will then be a binding contract on both parties, subject to all the above terms and conditions.  

THIS CONTRACT MAY NOT BE ASSIGNED OR TRANSFERRED BY THE MARE OWNER.
